Tax Consultants Raise Concerns Over Ambiguous and Error-Prone Anti-Evasion Legislation

The Chamber of Tax Consultants Urges President Iohannis to Reconsider Flawed Legislation

In a letter addressed to President Klaus Iohannis, the Chamber of Tax Consultants (CCF) has voiced serious reservations regarding a recently adopted anti-evasion bill, accusing it of being fraught with errors, open to interpretation, and riddled with logical inconsistencies. The letter calls for a reexamination of the legislation, highlighting its potential adverse impact on law-abiding taxpayers.

The Chamber of Tax Consultants (CCF) has taken a firm stance against a legislative initiative aimed at combating tax evasion, claiming that the proposed bill, championed by PSD leader Marcel Ciolacu and PNL leader Nicolae Ciucă, is marred by numerous flaws. The controversial legislation, swiftly approved by Parliament without adequate consultation, has prompted the CCF to address President Klaus Iohannis, urging him to reconsider its implementation.

Key Concerns Raised by Tax Consultants:

One of the contentious amendments in the bill criminalises the failure to withhold taxes at the source, a move criticised for its lack of clarity and predictability. The CCF argues that the absence of a precise definition for the term “failure to withhold at the source” renders the provision practically inapplicable, potentially leading to confusion and arbitrary enforcement—an unacceptable scenario in criminal law.

Critique of Legislative Process:

The letter also emphasises the rushed adoption of the legislation, pointing out that it occurred without proper consultation and scrutiny. The CCF contends that the bill, initiated by the leaders of PSD and PNL, underwent significant weakening through amendments, allowing a greater number of tax evaders to avoid criminal prosecution by merely reimbursing the damages with minimal penalties. This, according to the CCF, undermines the intended purpose of the legislation and could result in a reduced number of tax evasion cases reaching the National Anticorruption Directorate (DNA) and Directorate for Investigating Organised Crime and Terrorism (DIICOT).

The Chamber of Tax Consultants calls for a more comprehensive and thoughtful approach to address the challenges of tax compliance. The concerns raised in their letter to President Iohannis underscore the importance of thorough consultation and careful consideration in the formulation of legislation impacting the financial responsibilities of citizens.
